Welcome to Voils Hauling. These Terms & Conditions govern your use of https://voilshauling.com/ and any request for sand, gravel, driveway stone, dirt hauling, material delivery, or hourly dump truck rental services from Voils Hauling.
By using our website, submitting a request, accepting a quote, scheduling service, or allowing work to begin, you agree to these Terms & Conditions.
Quotes and estimates are based on the information available at the time they are provided. Material quantities, delivery costs, site conditions, access limitations, fuel costs, wait time, and other job-specific factors may affect final pricing.
Unless stated otherwise in writing, quotes are not guarantees of a final price and may be adjusted if project details, materials, delivery conditions, or requested services change.
The customer is responsible for providing accurate project, delivery, and contact information. The customer must ensure the delivery location is reasonably accessible and safe for a dump truck or other required equipment.
Before delivery or service, the customer is responsible for identifying and communicating:
The intended unloading or work area
Any underground utilities, septic systems, wells, drain fields, water lines, gas lines, electrical lines, irrigation lines, or other hidden hazards
Soft ground, steep grades, low-clearance areas, narrow driveways, gates, bridges, culverts, or other access limitations
Any property conditions that may affect safe delivery or operation
Voils Hauling may refuse, delay, or relocate a delivery if conditions appear unsafe or inaccessible.
Dump trucks and hauling equipment are heavy. The customer understands that delivery and travel across private property may create ruts, compaction, cracking, or damage to lawns, gravel drives, asphalt, concrete, culverts, septic systems, underground utilities, landscaping, or other surfaces and structures.
Voils Hauling is not responsible for damage caused by unsafe site conditions, hidden conditions, inadequate access, soft ground, customer-directed travel routes, or inaccurately marked delivery areas, except where damage is directly caused by our willful misconduct.
The driver retains final discretion regarding where equipment can safely travel, turn around, unload, or park.
Material appearance, color, texture, size, moisture content, and compaction may vary due to natural sourcing, weather, production, and handling conditions. The customer is responsible for confirming the requested material and quantity before delivery.
Once a load has been delivered or dumped at the customer’s direction, it generally cannot be returned, exchanged, or relocated without additional charges.
Hourly dump truck rental is subject to truck availability, scheduling, minimum charges, travel time, wait time, fuel, site conditions, and the terms provided in the applicable estimate or service agreement.
The customer is responsible for providing a safe and accessible worksite. Time may continue to be billed when the truck or driver is delayed due to site conditions, customer instructions, loading delays, unloading delays, blocked access, or other conditions outside Voils Hauling’s control.
Requested delivery dates and service times are estimates unless specifically confirmed in writing. Weather, road conditions, equipment availability, traffic, supplier delays, material availability, site conditions, emergencies, and other circumstances may require us to reschedule or delay service.
Voils Hauling is not responsible for delays or losses caused by circumstances outside our reasonable control.
Payment terms will be provided with your quote, invoice, or service agreement. Unless otherwise agreed in writing, payment is due as stated on the invoice.
Voils Hauling may require a deposit, prepayment, or payment at the time of delivery or service. Past-due balances may be subject to reasonable collection costs, interest where permitted by law, and attorney fees or other costs incurred to collect an unpaid balance.
If you need to cancel or reschedule service, please contact us as soon as possible. Cancellations made after materials have been ordered, dispatched, loaded, or delivered may be subject to charges for materials, delivery, travel time, labor, equipment time, or other costs already incurred.
We make reasonable efforts to keep website information accurate, but website content, service descriptions, availability, and pricing are provided for general information only and may change without notice. Nothing on this website creates a binding agreement unless confirmed by Voils Hauling in writing.
All content on this website, including text, logos, graphics, images, and design elements, is owned by or used with permission by Voils Hauling and may not be copied, reproduced, or used without written permission.
To the fullest extent allowed by law, Voils Hauling will not be liable for indirect, incidental, special, consequential, or punitive damages arising from website use, service delays, material variations, site conditions, customer instructions, or access limitations.
Our total liability for a claim related to services will not exceed the amount paid to Voils Hauling for the specific service giving rise to the claim, except where prohibited by law.
You agree to indemnify and hold Voils Hauling harmless from claims, damages, losses, or expenses arising from inaccurate information, unsafe site conditions, unmarked hazards, customer instructions, or your use of our website or services.
These Terms & Conditions are governed by the laws of the State of Indiana. Any dispute related to these Terms, the website, or our services will be handled in the appropriate courts serving Morgan County, Indiana, unless otherwise required by law.
Voils Hauling may update these Terms & Conditions at any time. Updates will be posted on this page with a revised effective date. Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.
